Vyper Shipping Protection

 

TERMS AND CONDITIONS

Your use of Vyper’s Purchase Protection Program (the “Program”) is subject to the following terms.  Purchase Protection is provided by Vyper Engineering, LLC.

The Program is a replacement service whereby a customer electing to participate in the Program will be eligible to receive a replacement product at no additional cost, subject to the terms listed below.

The Program is not an insurance policy. The program is not a service provided by an insurance carrier.

Overview

Vyper offers the Program to customers making eligible purchases through Vyper’s website (www.vyperindustrial.com). Purchases eligible for protection through the Program will display an option to participate in the Program for the fee stated on the checkout page.  A customer must elect to participate in the Program and pay the fee in order for the eligible purchase to be covered by the Program.

What is Covered

The Program provides protection against the cost of replacing an order that is lost in transit or marked as delivered but is not received. The Program will cover the cost of replacing the items in an order up to a maximum amount of $2,000 as well as the cost to ship the replacement to the customer at the address originally designated by the customer at the time of the original purchase.

How to Request a Replacement through the Program

If a customer purchases protection through the Program for an eligible order, and the order is lost in transit, the customer may request replacement at least 7 days after the last tracking update from the shipping carrier and no more than 30 days following the purchase of the order. 

If an order is marked as delivered by the shipping carrier but the order was not received by the customer, the customer may request replacement of the order no more than 30 days following the purchase of the order.

Delivered But Not Received

Claims for orders marked as delivered but not received by the customer must include proof of a filed police report concerning the order.

If no filed police report is attached, our customer support team will be unable to process replacement.

By requesting replacement through the Program, the customer waives any claim that the customer might have against the shipping carrier in connection with the missing order. The customer also waives any claim the customer might have against Vyper in connection with the missing order.

Program Limitations

The Program only applies to eligible orders that are lost in transit or marked as delivered but which are not received. The Program does not offer replacement for orders that are unsatisfactory to the customer for any reason.  The Program does not provide protection for orders that are returned to sender for any reason. 

The Program is limited to a replacement of the lost or stolen order, including the cost of shipping the replacement order to the customer. The Program does not offer payment or reimbursement for any damages sustained or that may be sustained by the customer or third parties as a result of the missing order or the delay in receiving the order. 

The Program only applies to orders which are paid in full by the customer, including the cost of shipping and enrollment in the Program. If a customer cancels payment for the order, in whole or in part, the customer will not be eligible to receive replacement under the Program and the Program fee will be forfeited by the customer. 

A customer is limited to a maximum of two (2) purchase protection claims under the Program in a twelve (12) month period. If a customer attempts to make a third claim under the Program in a twelve (12) month timeframe, Vyper is not obligated to provide any Program services to customer and may elect to refund the Program fee for the order. 

Incorporating Vyper Terms and Conditions

These terms constitute part of the Vyper Terms and Conditions. The provisions concerning limitations of liability, indemnity, governing law, dispute resolution, and waiver of terms by a party shall apply to all claims under the Program and are incorporated by reference herein. In the event of any conflict between the Vyper Terms and Conditions and this document, the Vyper Terms and Conditions shall prevail.
